**Services and service area**
-----------------------------

City to Summit Courier provides direct courier and delivery services within its available service area. Service availability depends on the pick up and delivery locations, vehicle and courier availability, item characteristics, weather, road conditions, and applicable laws.

We may decline or discontinue a delivery that cannot be completed safely or lawfully, that involves an undisclosed prohibited item, or that materially differs from the information supplied when the quote was requested.

**Quote validity**
------------------

Quotes are based on the information provided by the customer, including pick up and delivery addresses, requested timing, item count, weight, dimensions, contents, handling requirements, and access conditions.

Unless otherwise stated, a quote includes only the services specifically identified in the quote. Additional charges may apply for wait time, undisclosed excess weight, additional stops, address changes, return service, redelivery, storage, special handling, or other customer-requested services.

Pick up and delivery times are estimates unless City to Summit Courier expressly agrees in writing to a guaranteed time. We will make reasonable efforts to communicate a material change to the estimated price or delivery time.

Unless otherwise stated in writing, a quote is valid for 7 calendar days and remains subject to courier availability until the deposit is paid and the booking is confirmed.

**Winter delivery pricing and safety**
--------------------------------------

For deliveries with a scheduled pick up date between October 15th and April 15th, the quoted price includes the anticipated cost of ordinary seasonal winter-driving conditions. No separate winter, snow, ice, or hazardous-weather surcharge will be added solely because ordinary winter conditions are encountered.

Winter pricing does not require a courier to travel when conditions are unsafe, unlawful, or impracticable. Weather, road closures, chain restrictions, avalanche conditions, emergency orders, accidents, and similar conditions may cause delay, rerouting, rescheduling, or cancellation.

No winter-weather surcharge will be added because of those conditions. However, separately requested or authorized services—such as storage, redelivery, return service, additional stops, or a change of destination—may result in additional charges.

**Direct delivery** **booking fee**
-----------------------------------

A non-refundable booking fee equal to 25% of the total quoted service price is required to reserve and dispatch a courier. The exact reservation amount will be displayed before payment.

The deposit is credited toward the final amount due and is not an additional charge. Except where otherwise required by law, the deposit is non-refundable after booking if the customer cancels, reschedules, provides materially inaccurate information, or prevents pick up or delivery.

If City to Summit Courier cancels the service and does not provide a reasonable alternative, the deposit will be refunded unless the cancellation resulted from the customer’s actions, an undisclosed prohibited item, unsafe access, or materially inaccurate information.

**Payment authorization**
-------------------------

By accepting the quote and providing a payment method, the customer represents that the customer is authorized to use that payment method. The customer authorizes City to Summit Courier and its payment processor to:

1. Charge the stated 25% deposit when the booking is confirmed;
2. Securely retain the payment credential through the payment processor for this booking;
3. Apply the booking fee as a credit toward the final amount due;
4. Charge the same payment method for the remaining quoted balance upon completed or chargeable attempted delivery; and
5. Charge additional amounts objectively calculated under the accepted quote and these Terms.

This authorization applies only to the identified booking and does not authorize unrelated or recurring charges. The customer will receive an itemized receipt showing the quoted amount, deposit credit, additional charges, and final amount charged.

If the payment method is declined, the customer remains responsible for the unpaid balance and must provide another valid payment method.

**Additional charges**
----------------------

Wait time. The first 15 minutes after the courier’s recorded arrival at the pick up location and the first 15 minutes after arrival at the delivery location are complimentary. Additional wait time is charged at USD 1 per minute, rounded up to the next whole minute.

Excess weight. The first 50 lb of each item is included. Weight exceeding 50 lb per item is charged at USD 1 per additional pound, rounded up to the next whole pound, unless the item’s accurate weight was disclosed and included in the accepted quote.

Other charges. Additional charges may apply for additional stops, address changes, return service, redelivery, storage, permits, special handling, oversized items, undisclosed access restrictions, or other services requested or authorized by the customer.

Arrival, departure, wait time, route, and delivery completion may be documented using dispatch records, GPS records, photographs, messages, signatures, and courier records. Material discretionary changes will be communicated for customer approval when reasonably practicable.

**Customer-requested changes**
------------------------------

Changes to the pick up address, delivery address, delivery time, item count, item weight, dimensions, recipient, route, or number of stops may require a revised quote.

A change is not confirmed until accepted by City to Summit Courier. The customer authorizes charges arising from changes the customer requests or approves by telephone, text message, email, website, or other recorded communication.

**Cancellation and rescheduling**
---------------------------------

If the customer cancels after booking but before courier dispatch, the deposit remains non-refundable, but no remaining service balance will be charged unless otherwise disclosed in the quote.

If the customer cancels after the courier has been dispatched or has arrived, the deposit remains non-refundable and the customer may be responsible for $35 dispatch fee, plus incurred wait time, tolls, parking, return service, or other documented expenses.

Rescheduling is subject to availability and may be treated as a cancellation if requested fewer than 2 hours before the scheduled pick up.

No refund is due for a failed or attempted delivery caused by an incorrect address, unavailable customer or recipient, refused delivery, unsafe access, prohibited item, or other circumstance within the customer’s control.

**Pick up and delivery requirements**
-------------------------------------

The customer must provide complete and accurate pick up and delivery information, including names, addresses, unit numbers, access instructions, telephone numbers, delivery restrictions, and requested time windows.

Items must be packed, labeled, secured, and ready for transportation when the courier arrives unless packing or loading assistance is expressly included in the quote.

The customer must disclose stairs, elevators, loading docks, gated access, parking restrictions, difficult terrain, required permits, and any other condition that may affect safe pick up or delivery.

**Attempted and failed delivery**
---------------------------------

A delivery is considered attempted when the courier arrives at the correct delivery location within the agreed or reasonably communicated timeframe but cannot complete delivery because:

- The recipient is unavailable;
- The recipient refuses delivery;
- The customer supplied incorrect or incomplete information;
- Safe or lawful access is unavailable;
- Required identification, authorization, or payment is unavailable; or
- Another circumstance within the customer’s or recipient’s control prevents delivery.

An attempted delivery may be charged as provided in the accepted quote. Redelivery, return service, storage, additional mileage, and additional wait time may result in additional charges.

**Proof of delivery**
---------------------

Delivery is complete when the item is:

- Accepted by the named recipient or another person reasonably believed to be authorized at the delivery location;
- Placed at the location expressly authorized by the customer;
- Documented through a signature, photograph, delivery timestamp, recipient name, GPS record, or similar proof; or
- Otherwise completed according to the customer’s written instructions.

If the customer authorizes an unattended delivery, responsibility for the item transfers upon placement at the authorized location, to the extent permitted by law.

**Customer responsibilities**
-----------------------------

The customer is responsible for accurately disclosing:

- The number, contents, value, dimensions, and weight of all items;
- Fragile, perishable, temperature-sensitive, high-value, or unusually shaped items;
- Special handling requirements;
- Pick up and delivery restrictions; and
- Any condition that may affect safe and lawful transportation.

The customer represents that the customer owns the items or is authorized by the owner to arrange their transportation.

**Prohibited and restricted materials**
---------------------------------------

- Illegal goods
- Undisclosed hazardous materials
- Undisclosed firearms and ammunition
- Controlled substances
- Undisclosed currency and negotiable instruments
- Undisclosed live animals
- Human remains
- Biological materials
- Unpackaged sharp objects
- Items requiring licenses or temperature controls that customer does not provide

The customer may not tender any illegal, dangerous, hazardous, regulated, or prohibited item without prior written disclosure and acceptance by City to Summit Courier. We may inspect, refuse, return, or stop transporting an item if we reasonably believe it was misrepresented or cannot be transported safely or lawfully. Applicable charges remain due when service is interrupted because of the customer’s nondisclosure or misrepresentation.

**Delays and circumstances outside our control**
------------------------------------------------

City to Summit Courier is not responsible for delay or nonperformance caused by circumstances outside its reasonable control, including severe weather, unsafe roads, closures, traffic incidents, mechanical failures, government orders, natural disasters, fires, emergencies, or acts of third parties.

We may delay, reroute, reschedule, or cancel service when reasonably necessary for safety or legal compliance. We will make reasonable efforts to notify the customer and complete the delivery when conditions permit.

**Loss and damage claims**
--------------------------

Visible loss or damage should be reported promptly upon delivery. Other claims should be submitted in writing to info@citytosummitcourier.com within 7 calendar days after delivery, together with the quote or invoice number, photographs, proof of value, repair or replacement documentation, and a description of the packaging and alleged damage.

The customer must retain the item and packaging for reasonable inspection. City to Summit Courier will review properly documented claims in good faith.

Any declared-value coverage, cargo coverage, valuation limit, exclusion, or liability limit must be expressly stated in the accepted quote or these Terms.

**Final payments, billing concerns, and chargebacks**
-----------------------------------------------------

Except where a refund is required by law, deposits and charges properly incurred under the accepted quote and these Terms are final and non-refundable.

A customer who believes a charge is incorrect should contact City to Summit Courier at info@citytosummitcourier.com or 1-720-786-6036 and provide the invoice number, disputed amount, and reason for the concern. We will review the matter in good faith and correct any verified duplicate, unauthorized, or incorrectly calculated charge.

Before initiating a chargeback, the customer agrees to make a good-faith effort to resolve the concern directly with City to Summit Courier, unless doing so would interfere with a right or deadline under applicable law or the customer’s financial institution’s rules.

City to Summit Courier may contest an improper chargeback using the accepted quote, payment authorization, customer communications, GPS records, timestamps, photographs, signatures, courier records, and proof of delivery.

Knowingly disputing a properly authorized charge by falsely claiming that authorization was not provided or that a completed service was not performed may constitute chargeback abuse or fraud. We may pursue unpaid balances through lawful collection procedures and recover costs only where permitted by law.

Nothing in this section waives a right or remedy that cannot lawfully be waived.

**Communications**
------------------

The customer consents to receive transactional communications concerning quotes, booking, courier arrival, delays, delivery, receipts, and billing by telephone, email, or text message using the contact information supplied by the customer.

Consent to transactional communications is not consent to receive unrelated marketing messages.

**Privacy policy**
------------------

Personal information is handled according to our [Privacy Policy](https://citytosummitcourier.com/privacy-policy/). Payment information is processed by our third-party payment processor. City to Summit Courier does not intend to store complete payment-card numbers or card security codes on its website.

**Governing law and disputes**
------------------------------

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any legal proceeding must be brought in a court with jurisdiction in Denver County, Colorado, USA, unless applicable law requires otherwise.

**Severability and no waiver**
------------------------------

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

A failure by City to Summit Courier to enforce a provision on one occasion does not waive the right to enforce it later.

**Changes to the terms**
------------------------

We may update these Terms from time to time. The version accepted when a delivery is booked will govern that booking unless the customer and City to Summit Courier agree otherwise in writing. The effective date and version number appear at the top of this page.
